INFORMATION ABOUT TRADEMARK REGISTRATION
Direção Marcas & Patentes, with the intention of facilitating and speeding the registrations of its clients, proceeds with the following methods concerning the trademark’s registry:
To provide with a trademarks registry, you must necessarily proceed with a technical analyses together with the INPI - National Institute of Industrial Property, with the purpose of checking the registry’s availability, as well as the possible risks to obtain it.
At this phase, the search is imperative and essential; also it is obliging for this search to be performed by a professional in the area, as a misleading search can compromise all of the procedure.
To understand the activities on where the trademark can be commercially explored, there has to be a thoroughly analysis on which classes the trademark can be registered.
According to Direção Marcas & Patentes, the first step to start the registry’s process is for the holder to yield the following information:
- CNPJ (National Record of Juridical Person – it is a number that identifies the juridical person within the Brazilian IRS)
- Full name of the person responsible for the company;
- RG (Brazilian Identity Card), CPF (tax payer’s number), nationality, marital status, profession;
- Description of the trademark that you want to register;
- Description of the activity on which the trademark will be commercialized.

After that, a formal document will be forwarded which regards the authorization for the trademark’s registry to be performed.
As soon as these aspects are defined, Direção will gather the necessary documents for the registry. The necessary documents are:
- Social Contract and any attachments or alterations if any;
- Logo, if any;
- Signed and registered Power of Attorney.
Note: The above mentioned documents refer to the juridical person that has been constituted legally, of limited responsibility; there is the possibility of other holders to register trademarks, such as: liberal and self-employed professional workers, associations, international companies, companies, amongst others.
